THE THEORETICAL ASPECTS OF FORMING OF LIMITATIONS IN LAND TENURE

Abstract


The article is devoted to the problems of forming and successful functioning of limitations in land tenure. An aim and task of the establishment of limitations for different categories of land have been defined. It also has been determined that the limitations related to the leaseholders of land and temporal land users are currently the most important in land tenure. In this case, two main directions of the development of limitations in land tenure are proposed. The first one is related to the system of the appropriate permissions and prohibitions for each land user group, and the second to the appropriate permissions and prohibitions for different forms of land tenure. In connection with this, it is proposed to develop limitations in land tenure and taking into account not only for corresponding territorial descriptions, but the relations of land ownership as well. In accordance with limitations in land tenure should be formed in ecological, social, legal and productive aspects. The necessity of establishment of limitations in types of permitted or prohibited works, as well as in types of land user rights for land parcels has been proved. The prospects of stimulation of rational directions of land use have been determined and their interrelation with the established limitations has been examined.
